Maritime law

Law 153-98 establishes the principle of free provision of telecommunications services, and therefore any business that meets the requirements (including the need to be incorporated as a limited liability Dominican company) is entitled to apply for grants for the provision of telecommunications services, which are granted by INDOTEL for renewable periods of five to twenty years. Application for the issue should be handled in accordance with the principles of equal treatment and nondiscrimination. The licenses for the use of radio-electric spectrum are granted through public bidding. As for services, broadband transmission, applicants must be Dominican nationals.

Since the provision of telecommunications services in the public interest and social, dealers are entitled to the following to install their networks and / or equipment: (I) to connect their equipment to public telecommunications networks, (ii) use the property public, (iii) create easements on private property, and (IV) interconnect its networks with other dealers.

Law 153-98 establishes several rules to promote the free operation of the telecommunications market in conditions of effective competition. Establishes the principle of minimal regulation and maximum operating the market in all aspects, including pricing and negotiations between suppliers. INDOTEL may intervene only when there are not sufficient conditions in the market to ensure effective competition.

Technical standards comply with international practices applied in the area where the country belongs, which is the World Zone No. 1 (composed of the United States, Canada and a group of islands in the Caribbean).
